1. Scope of Application

These Terms and Conditions (“T&C”) govern all contractual relationships between myroom AG, Kiesweg 10, 3904 Naters, Switzerland (hereinafter referred to as “myroom”) and its customers (hereinafter referred to as the “Tenant”).

By completing an online booking for a hobby room, the Tenant confirms that they have read, understood, and accepted these Terms and Conditions.

Any terms and conditions of the Tenant that conflict with these T&C shall not apply.

2. Services Offered

myroom rents out modern hobby rooms, leisure rooms, workspaces, creative studios, and project rooms to private individuals.

Depending on the location, the following services may be included in the rental fee:

  • Electricity
  • Heating
  • Internet access
  • 24/7 access
  • Sanitary facilities
  • Parking spaces (subject to availability)

The exact services included depend on the respective location.

3. Conclusion of the Rental Agreement

The rental agreement is concluded exclusively through the online booking platform operated by myroom.

Submitting an online booking constitutes a binding rental agreement.

However, the agreement shall only become effective once:

  • the first month’s rental payment; and
  • the security deposit of CHF 100.00

have been received in full by myroom.

Once payment has been confirmed, the Tenant will receive digital access to the rented room.

No handwritten signature is required for the agreement to become legally binding.

4. Rental Term

The rental agreement is concluded for an indefinite period.

There is no minimum rental period.

Either party may terminate the agreement by giving one month’s notice, effective at the end of a calendar month.

Termination must be submitted in writing by email.

5. Rental Fee

The monthly rental fee must be paid in advance.

Payments are accepted exclusively by bank transfer.

The rental payment must be received by myroom before the beginning of each rental month.

6. Security Deposit

A security deposit of CHF 100.00 is required upon conclusion of the rental agreement.

The security deposit may be used to cover, among other things:

  • Outstanding rental payments
  • Cleaning costs
  • Waste disposal costs
  • Damage to the premises
  • Any other outstanding amounts owed to myroom

The security deposit does not accrue interest.

Provided the room is returned in proper condition and all contractual obligations have been fulfilled, any remaining balance of the security deposit will be refunded within a reasonable period.

7. Late Payment

If a rental payment is not received by the due date, the following payment reminder procedure shall apply:

  1. A payment reminder will be sent after 10 days.
  2. A second reminder may be issued together with an administrative reminder fee.
  3. A third reminder may be issued together with an additional reminder fee.

If payment is still not received after the third reminder, myroom reserves the right to:

  • immediately suspend the Tenant’s digital access to the rented room; and
  • terminate the rental agreement with extraordinary notice effective at the next possible end of the calendar month.

Provided the room has been vacated, cleaned, and returned in accordance with these Terms and Conditions, any remaining security deposit will be refunded in accordance with Section 6.

8. Use of the Hobby Room

The rented room may be used freely, provided that all applicable laws and these Terms and Conditions are respected.

Permitted activities include, but are not limited to:

  • Hobbies and personal projects
  • Arts and crafts
  • Music practice
  • Band rehearsals
  • Drumming and other musical instruments
  • Woodworking and general craftsmanship
  • Creative work
  • Leisure activities
  • Private workshops
  • Private celebrations and events

When using the premises, the Tenant shall always respect other tenants, neighbouring properties, and the applicable House Rules of the respective location.

Depending on the nature and scale of an event, myroom may request additional information or require prior approval.

The rented room may not be used for any purpose that violates applicable law or endangers the safety of the building or its occupants.

9. Prohibited Uses

The following activities and items are prohibited, in particular:

  • Storage or handling of explosive materials
  • Petrol, diesel, or other highly flammable liquids
  • Gas cylinders without prior written approval
  • Fireworks and pyrotechnics
  • Weapons and ammunition where prohibited by law
  • Illegal drugs or narcotics
  • Toxic or hazardous substances
  • Radioactive materials
  • Dangerous chemicals
  • Illegal activities of any kind
  • Manufacturing or storing prohibited goods
  • Activities that may compromise the safety of the building
  • Activities causing excessive risk to persons or property

For safety reasons, myroom reserves the right to prohibit additional items or activities at any time.

10. Alterations and Installations

Minor installations such as:

  • Shelving
  • Workbenches
  • Cabinets
  • Wall brackets and storage systems

are permitted, provided they do not significantly affect the structural integrity or permanently damage the building.

Major alterations, structural modifications, demolition work, or permanent installations require the prior written approval of myroom.

Any approved alterations must, unless otherwise agreed, be removed by the Tenant before the end of the rental agreement and the room restored to its original condition.

11. Vehicles

Motor vehicles powered by combustion engines may only be stored inside a rented room with prior written approval from myroom.

myroom may impose additional safety requirements or operating conditions depending on the location and intended use.

The storage of fuel or hazardous automotive materials remains prohibited unless expressly authorised in writing.

12. Digital Access

Access to the rented room is provided through a digital locking system.

The primary Tenant is the administrator of the digital access and is responsible for managing all access permissions.

The Tenant may grant access to additional users at their own discretion.

The primary Tenant remains fully responsible for the conduct and actions of every person to whom access has been granted.

Digital access credentials must be treated confidentially and may not be shared with unauthorised persons or used improperly.

myroom reserves the right to suspend or deactivate digital access immediately in the event of:

  • late payment,
  • misuse of the access system,
  • security concerns,
  • violations of these Terms and Conditions, or
  • any situation requiring immediate protective measures.

Whenever reasonably possible, the Tenant will be informed of such measures without undue delay.

13. Services Provided by myroom

myroom shall provide the agreed services with due care and diligence.

Depending on the location, the rental fee may include services such as electricity, heating, internet access, sanitary facilities, and parking spaces.

Temporary interruptions or restrictions of these services may occur due to:

  • maintenance work;
  • technical failures;
  • force majeure;
  • official orders;
  • construction or renovation work; or
  • circumstances beyond myroom’s reasonable control.

Internet access is provided free of charge where available.

myroom does not guarantee uninterrupted availability, minimum speeds, or compatibility with specific devices or applications.

14. Insurance

Items stored or kept within the rented room are not insured by myroom.

The Tenant is solely responsible for arranging appropriate insurance coverage for their personal belongings and any liability arising from their use of the premises.

Upon request, myroom may provide information regarding optional insurance solutions offered through selected partners, such as Allianz.

15. Liability

The Tenant uses the rented premises entirely at their own risk.

To the maximum extent permitted by Swiss law, myroom shall not be liable for any loss of or damage to property resulting from, including but not limited to:

  • theft;
  • burglary;
  • vandalism;
  • fire;
  • water damage;
  • power outages;
  • force majeure;
  • technical failures;
  • actions of third parties; or
  • damage to items brought onto the premises by the Tenant or authorised users.

Nothing in these Terms and Conditions excludes liability where such exclusion is prohibited by applicable law.

myroom remains liable only for damages caused intentionally or through gross negligence.

16. Right of Access

myroom retains a master access right to all rented premises.

Access by myroom shall only take place where there is a legitimate reason, including but not limited to:

  • emergencies;
  • imminent danger to persons or property;
  • suspected violations of these Terms and Conditions;
  • necessary maintenance, repair, or inspection work;
  • compliance with legal or governmental requirements.

Whenever reasonably possible, the Tenant shall be informed in advance.

In urgent situations, myroom may enter the premises immediately without prior notice.

17. Video Surveillance

For the safety and security of all tenants and visitors, myroom premises may be monitored by video surveillance systems.

Building entrances, common areas, and digital access events may be recorded and logged.

Personal data shall be processed exclusively in accordance with the applicable Swiss data protection legislation and the Privacy Policy of myroom.

18. Return of the Room

The rented room must be completely emptied, cleaned, and returned in a broom-clean condition no later than the final day of the rental agreement.

Any personal belongings must be removed before the end of the tenancy.

If cleaning, repairs, or waste disposal become necessary, myroom reserves the right to charge the Tenant for the resulting costs.

Depending on the condition of the premises, additional cleaning and disposal charges of up to CHF 200.00 or more may apply.

These costs may be deducted in whole or in part from the security deposit.

19. Property Left Behind

Following termination of the rental agreement, myroom will request that the Tenant collect any remaining property within 30 days.

If the property has not been collected within this period, myroom shall be entitled to dispose of, recycle, sell, or otherwise realise such property at the Tenant’s expense.

The Tenant shall not be entitled to any compensation for items disposed of or realised after the expiry of the collection period.

20. Data Protection

The processing of personal data is governed by the Privacy Policy of myroom.

The current version of the Privacy Policy is available on the myroom website.

21. Business Customers

The online booking platform is primarily intended for private individuals.

Businesses or commercial customers are requested to contact myroom directly before entering into a rental agreement.

myroom reserves the right to offer separate contractual terms for commercial customers.

22. House Rules

Each myroom location has its own House Rules.

The applicable House Rules form an integral part of the rental agreement and must be observed by all tenants, visitors, and authorised users.

Failure to comply with the House Rules may result in suspension of access or termination of the rental agreement.

23. Amendments to these Terms and Conditions

myroom reserves the right to amend these Terms and Conditions at any time.

Any amendments will be communicated to tenants in an appropriate manner.

The latest version published by myroom shall apply to all future rental periods, unless mandatory legal provisions require otherwise.

24. Governing Law and Place of Jurisdiction

These Terms and Conditions and all contractual relationships between the Tenant and myroom shall be governed exclusively by Swiss law.

To the extent permitted by law, the exclusive place of jurisdiction shall be Brig-Glis, Canton of Valais, Switzerland.
